The Government "Enacted" Justice

The Union for the Reconstruction of Romania - URR is feeling that the unconstitutionalised alteration, through an emergency ordinance of the Civil Procedure Code is undertaking the whole edifice of the Romanian justice. Altered three times during the last three years, this code is now adapted to the power's interests without that the professional organizations of the field to have been consulted.

The changes the government made are drastically diminishing the Court of Appeal competencies in favor of the Supreme Court of Justice, under the pretext of the judicial unification practice. This argument is illogical because, anyway the most justiciables are practicing their right of pursuing its goal till the Supreme Court, fact recognized even by the management of the ministry. In fact, the only result that can thus be obtained would be the accidental or deliberate suffocation of the Supreme Court. And the inevitable enlargement of the personnel scheme would be probably used, just as till now, for imposing PSD devoted magistrates.

The unsuccessful centralization of the appeals at the Supreme Court of Justice is "compensated" by a decentralization as much as unsuccessful as the first one, by redistributing competencies within the commercial field to judicature and courts where one often lack the necessary preparation.
